Terms and conditions
1. Scope
These terms apply to contracts with Steiner-Gas GmbH, Halbgasse 18/2, 1070 Wien, where validly agreed before the contract is concluded. They cover businesses and consumers. Individual agreements take precedence. Mandatory consumer rights are not restricted. Publication alone does not retrospectively incorporate these terms into existing contracts.
2. Offers and contracts
The website describes our offering. A form enquiry is not an order and creates no payment obligation. Gas, purity, container, cylinder arrangement, quantity, price and delivery conditions are specified in the individual offer. A contract is concluded by matching declarations of the parties. Authority to represent the company follows statutory rules.
3. Prices and payment
Agreed prices and payment periods apply. Consumer offers state the total price including VAT and known additional costs. Delivery, transport, rental and other additional charges are disclosed before contract conclusion. Statutory default interest applies; necessary, appropriate and proportionate recovery costs may be claimed subject to the law.
4. Delivery
Delivery area, date, access and handover are agreed individually. Statutory rights in case of delay remain. For consumers, risk generally transfers only on handover to the consumer or a nominated third party, subject to statutory exceptions. Gas cylinders must be transported in compliance with applicable transport and safety rules.
5. Cylinders and ownership
The individual contract determines whether a cylinder is bought, rented, exchanged or temporarily supplied. Return periods, deposits, rent and late-return charges must be transparently agreed before conclusion. Third-party or damaged cylinders are not automatically accepted for exchange. Sold goods remain our property until fully paid. Statutory rules govern damage, loss and return; no blanket penalty of twice the invoice amount is agreed.
6. Safety and use
Observe labels, safety data sheets and operating instructions. Do not use damaged or leaking cylinders. Inform us about apparent defects or damage; in immediate danger contact the appropriate emergency services. Cylinders must not be filled, altered or used for different gases without the necessary authorisation.
7. Warranty and liability
Statutory warranty and damages rules apply. Consumers do not lose warranty rights by failing to report defects immediately. The statutory inspection and notification duty under section 377 UGB applies to transactions that are commercial for both parties. Claims for personal injury, intent, gross negligence or under product liability law are not excluded or capped at the invoice amount.
8. Consumers and distance contracts
Consumers generally have a statutory 14-day right of withdrawal for distance and off-premises contracts. For goods, the period generally starts on receipt; for services, on contract conclusion. An unequivocal statement to office@steiner-gas.at or the address above is sufficient; sending it in time meets the deadline. Statutory exceptions apply only where their actual conditions are met. Gas cylinders are not categorically excluded from withdrawal.
9. Withdrawal procedure
The withdrawal instructions and model form for the particular distance contract are provided before conclusion. Refunds and returns follow the Austrian FAGG, including statutory 14-day periods, the right to withhold reimbursement until goods or proof of return are received, and rules on diminished value. Any return costs payable by the consumer, especially for cylinders unsuitable for postal return, are specifically disclosed beforehand. Coordinate safe return transport with us; withdrawal is not conditional on our consent.
10. Law and disputes
Austrian law applies; mandatory consumer protection in the country of habitual residence remains where its legal requirements are met. Statutory set-off and retention rights and jurisdictions remain unaffected. No exclusive Vienna jurisdiction is agreed for consumers. Statutory rules apply if a clause is invalid.
